These terms explain how working with Acton Studio works. Acton Studio is operated by Blair Acton, a sole proprietor based in Birmingham, Alabama ("we," "us"). "You" means the business or person using our services. By paying for or using our services, you agree to these terms. Questions? Email blair@actonstudio.com.
1. Our services
We design, host, and maintain simple one-page websites for local businesses. That includes building the site, hosting it with HTTPS, connecting your domain if you have one, and making small updates while you're subscribed. Previews we build before you sign up are free and come with no obligation.
2. Pricing and payment
- Setup fee: $250, one time, due before your site goes live.
- Monthly fee: $25 per month for hosting and small updates, billed monthly by card through Stripe. Your subscription renews automatically each month until you cancel.
- Prices don't include any domain registration fees, which are paid to the domain registrar.
- If we ever change our prices, we'll email you at least 30 days before the change applies to you.
- If a payment fails, we'll let you know. If it isn't resolved within 14 days, we may take your site offline until payment is made.
3. Cancelling
You can cancel anytime by emailing blair@actonstudio.com. Cancellation takes effect at the end of your current billing period. You won't be charged again, and your site stays live until that period ends.
4. Refunds
- If you change your mind before your site goes live, we'll refund your setup fee in full.
- Once your site has gone live, the setup fee is not refundable.
- Monthly fees are not refunded for partial months. When you cancel, you keep service through the end of the month you've paid for.
5. Your content
You're responsible for making sure the information you give us (business details, hours, prices, licenses, and so on) is accurate, and that you have the right to use any logos, photos, and text you send us. You keep ownership of your business name, logos, photos, and content. You give us permission to use them to build, host, and update your site.
6. Changes and updates
Reasonable change requests are included in your monthly fee. That means small updates like changing text, swapping photos, or updating your hours, phone number, or list of services. We usually finish them within 1 to 2 business days. Larger work, such as a redesign, new pages, or new features, is quoted separately, and we'll agree on a price with you before starting.
7. When your subscription ends
- Your site goes offline when your subscription ends.
- You can ask for a copy of your site's files at that time, and we'll send them to you.
- If you own your domain, it stays yours. We'll help point it somewhere else if you need it.
8. Hosting and uptime
We host sites on reliable infrastructure and work to keep them online and fast, but we can't promise the site will be available 100% of the time. Outages caused by hosting providers, internet problems, or things outside our control can happen. If your site goes down, we'll work to get it back up as quickly as we reasonably can.
9. Limitation of liability
We provide our services "as is." To the fullest extent the law allows, Acton Studio is not liable for indirect or consequential losses, such as lost profits, lost business, or lost data. Our total liability for any claim related to our services is limited to the amount you paid us in the 3 months before the claim.
10. Ending service
We may suspend or end service if payment isn't made, or if a site is used for anything illegal, misleading, or harmful. Except in serious cases, we'll give you notice by email first.
11. Governing law
These terms are governed by the laws of the State of Alabama. If a disagreement comes up, we'll try to work it out together first.
12. Changes to these terms
We may update these terms from time to time. We'll post the new version here with a new effective date and email current clients about significant changes. Continuing to use our services after a change means you accept the updated terms.
